1. Agreement
These Terms of Service (the "Terms") form a binding agreement between you and [COMPANY LEGAL NAME] ("Haya", "we", "us", "our"). They govern your access to and use of the Haya mobile application, website, and any related services (together, the "Service").
By creating an account, signing in, or otherwise using the Service, you confirm that you have read, understood, and agreed to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
2. Who can use Haya
Haya is a halal-conscious matrimony and serious-relationships platform. To use the Service you must:
- Be 18 years of age or older
- Be legally permitted to use a matrimony or relationships service in the country where you are located
- Not be subject to a current suspension or removal from Haya
- Not be listed on any United Nations, UAE, US, UK, or EU sanctions list
- Be using the Service for yourself, in good faith, and not on behalf of any other person
You confirm each of the above every time you use the Service.
3. Your account
3.1 Creating an account
You can create a Haya account using your mobile phone number via SMS one-time password. You agree to provide accurate information and to keep it current. You may not impersonate another person, use someone else's contact details, or create more than one active account.
3.2 Identity verification
You may be asked to complete identity verification through our partner Veriff. Identity verification is optional for browsing, but may be required to unlock certain features, to send messages, or to keep your account in good standing. We may decline to verify, or revoke a verified status, where we believe the underlying data is inaccurate, fraudulent, or in breach of these Terms.
3.3 Security of your account
You are responsible for keeping your sign-in credentials and your device secure. Notify us immediately at [[email protected]] if you suspect that someone else has accessed your account.
4. The Service
Haya helps adults discover, evaluate, and start conversations with potential partners for serious relationships and marriage. The Service includes, among other things:
- A profile builder (including an optional AI-assisted helper)
- A discovery feed of suggested profiles
- Matches, super-likes, and curated introductions
- One-to-one chat (including optional message translation and suggested openers)
- Identity verification, safety controls, blocking, and reporting
- Paid features under the Haya Plus subscription
The Service is provided on an evolving basis. We may add, change, or remove features at any time. Where a material change reduces a paid feature you have already purchased, your remedy is described in section 7.
5. Acceptable use and community rules
Haya is built for respectful, halal-conscious connections. You agree that you will not, and will not attempt to:
- Post or send sexually explicit, pornographic, or nude content of any kind, including suggestive or otherwise non-halal material
- Harass, threaten, intimidate, stalk, or abuse any user
- Discriminate against or vilify any user on the basis of religion, sect, nationality, ethnicity, gender, disability, or any other protected characteristic
- Misrepresent yourself, your age, your photographs, your marital status, or any other material fact
- Use the Service for commercial solicitation, prostitution, escort services, sex work, multi-level marketing, recruitment, fundraising, political campaigning, or any other purpose that is not your own personal search for a serious relationship
- Engage in romance scams, financial scams, advance-fee fraud, gift-card fraud, crypto fraud, "pig-butchering" scams, or any similar deception
- Distribute spam, viruses, or malicious code of any kind
- Scrape, mirror, or systematically copy the Service, its content, or user information
- Circumvent, reverse-engineer, decompile, or disassemble the Service or any rate limits or safety controls we use
- Use bots, scripts, or other automation to access the Service
- Use the Service to harm minors in any way; child safety is non-negotiable
- Upload content that violates UAE Federal Decree-Law No. 34 of 2021 on combatting rumours and cybercrime, the UAE Penal Code, or any other applicable law
- Disclose another user's personal information (including photographs, identity, or chat content) to anyone outside Haya without their explicit consent
Violations may result in the removal of content, the suspension or termination of your account, refusal of refunds, and where appropriate disclosure of information to competent authorities — see section 13.
6. Content you create and share
6.1 Your content
You retain ownership of the photographs, text, voice notes, and other content you submit to Haya ("Your Content"). You confirm that you have all rights necessary to share Your Content with us and with other Haya users.
6.2 Licence you grant to Haya
You grant Haya a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, adapt, translate (including using AI), display, and distribute Your Content solely for the purpose of operating, providing, improving, and securing the Service. This licence ends when you delete Your Content or your account, except that:
- We may retain copies in routine backups for the period described in our Privacy Policy, after which they are overwritten
- We may retain limited records (including hashes or fingerprints) of content removed for safety reasons so that we can enforce these Terms consistently
We do not sell Your Content, and we do not use Your Content to train any third-party AI model. Translation and suggested-opener features described in our Privacy Policy operate on a per-request basis and do not amount to model training.
6.3 Content you receive from others
Other users grant you a limited, personal, non-transferable licence to view their content inside the Service. You may not download, screenshot, copy, or republish another user's photographs, messages, or other personal content outside the Service without their explicit consent, except as required by law.
6.4 Our content
The Service itself — including the Haya name, logo, designs, code, copy, illustrations, and curated content — is owned by Haya or its licensors and is protected by intellectual-property laws. We grant you a limited, personal, non-transferable, revocable licence to use the Service for the purposes described in these Terms. All rights not expressly granted are reserved.
7. Subscriptions, payments, and refunds
7.1 Free and paid features
Most core features of Haya are free. Some features (together, "Haya Plus") are available only via a paid subscription. The features included in Haya Plus and their prices are shown inside the app and may change from time to time.
7.2 How you pay
Paid subscriptions are sold and processed through the Apple App Store or the Google Play Store, depending on your device. We use RevenueCat to receive and reconcile subscription events from those stores. Haya itself does not receive your full payment-card details.
7.3 Auto-renewal
Subscriptions renew automatically at the end of each billing period at the then-current price, unless you cancel before the renewal date. To cancel, manage your subscription in your Apple ID settings (iOS) or your Google Play account (Android). Cancelling stops the next renewal but does not refund the current period.
7.4 Refunds
Refunds are handled by Apple or Google in accordance with the policies of the App Store or Google Play. Haya cannot issue direct refunds for in-app purchases. Where consumer-protection law in your country requires a different outcome, that law prevails.
7.5 Promotions and trials
We may offer free trials, discounted introductory periods, or promotional codes. The specific terms of any promotion will be displayed at the point of offer; if you do not cancel during the trial period, you will be charged at the then-current price when the trial ends.
7.6 Taxes
Prices shown include applicable VAT or other consumption taxes unless we say otherwise. Where required, the App Store or Google Play will collect and remit those taxes.
8. AI-assisted features
The profile builder, message translator, and suggested openers use third-party AI models (currently Google's Gemini family) to help you draft content and communicate across languages. You understand that:
- AI output is suggestive, not authoritative. It may be inaccurate or culturally inappropriate. You are responsible for reviewing it before sending or publishing.
- We do not warrant that translations are perfect. Communicate critical information (for example regarding meeting in person, finances, or family decisions) carefully.
- You should never share national ID numbers, passwords, full payment-card numbers, or other secrets through chat or through AI-assisted features.
9. Meeting in person and safety
Haya is an online introduction service. We do not conduct background checks beyond optional identity verification, and we do not guarantee that any user is who they claim to be, that they will be safe, compatible, or honest, or that any introduction will result in a relationship or marriage. You are solely responsible for your interactions with other users, including any decision to meet in person. We strongly recommend that you:
- Get to know someone inside the Service before exchanging external contact details
- Tell a trusted friend or relative where you are going and meet for the first time in a public place
- Involve your family or wali where that is appropriate for you
- Never send money, gifts, or financial information to someone you have only met online
- Report suspicious behaviour to us immediately using the in-app reporting tools
If you believe you are in immediate danger, contact your local emergency services.
10. Suspension and termination
10.1 Termination by you
You can stop using the Service at any time and delete your account from the in-app settings. Cancelling an active subscription is described in section 7.
10.2 Termination or suspension by us
We may suspend or terminate your access to the Service, with or without notice, if we reasonably believe that you have:
- Breached these Terms or our community rules
- Acted in a way that puts other users or the integrity of the Service at risk
- Used the Service for an unlawful purpose under the laws of the UAE or any other applicable jurisdiction
- Submitted false identity-verification data
- Engaged in payment fraud or chargeback abuse
Where we suspend an account we will normally explain why and (where appropriate) give you an opportunity to appeal. For serious or repeated breaches, or where required by law, we may terminate without notice.
10.3 Effect of termination
When your account is terminated, your right to use the Service ends. Sections that by their nature should survive termination — including sections 6 (licences), 7 (payments and refunds), 11 (disclaimers), 12 (limits on liability), 13 (legal disclosure), 14 (governing law), and 15 (general) — will continue to apply.
11. Disclaimers
The Service is provided "as is" and "as available", without warranty of any kind, except where prohibited by law. To the maximum extent permitted by law:
- We do not warrant that the Service will be uninterrupted, error-free, or secure
- We do not warrant that any introduction will lead to a relationship, engagement, marriage, or any particular outcome
- We do not warrant that other users are who they say they are, will behave in any particular way, or are suitable for you
- We do not warrant that identity verification, content moderation, or safety controls will detect every harmful actor
Some jurisdictions do not allow the exclusion of certain warranties. Nothing in these Terms limits warranties or rights that cannot lawfully be excluded.
12. Limitation of liability
To the maximum extent permitted by law, Haya and its officers, directors, employees, and agents will not be liable for:
- Any indirect, incidental, special, consequential, or punitive damages, including loss of profit, loss of data, loss of reputation, or loss of opportunity
- Any damage arising out of, or in connection with, your interaction with another user, including any meeting that takes place online or offline
- Any damage arising out of content posted by another user that we have not yet reviewed or removed
- Any damage caused by events outside our reasonable control (such as network outages, force majeure, government action, or third-party-provider failure)
Our aggregate liability to you for any claim arising out of or relating to the Service or these Terms will not exceed the greater of:
- the amount you have paid to Haya in the twelve months before the event giving rise to the claim, or
- [AED 500 / USD 100]
Nothing in this section limits liability that cannot be limited under applicable law, including liability for death or personal injury caused by our negligence, or for fraud.
13. Legal compliance, reports, and disclosure
We comply with the laws of the United Arab Emirates and the laws of other jurisdictions where we offer the Service. We may disclose information about you (including content you have submitted) to a court, regulator, or law-enforcement authority where we believe in good faith that doing so is necessary to comply with the law, to enforce these Terms, or to protect the rights or safety of Haya, our users, or the public — see also section 11 of our Privacy Policy.
14. Governing law and dispute resolution
These Terms are governed by the laws of the United Arab Emirates and the Emirate of [DUBAI / ABU DHABI / OTHER].
Any dispute arising out of or in connection with these Terms or the Service shall be submitted to the exclusive jurisdiction of the [DUBAI COURTS / DIFC COURTS / ADGM COURTS]. Nothing in this section prevents either party from seeking interim or injunctive relief in any competent court. If you are a consumer in a jurisdiction whose law grants you the right to bring proceedings in your local courts, that right is preserved.
15. General
15.1 Changes to these Terms
We may update these Terms from time to time. When changes are material we will notify you in-app, by SMS, or by another reasonable means at least [30 days] before the changes take effect. If you continue to use Haya after a change takes effect, you accept the updated Terms; if you do not agree, you can stop using the Service and delete your account before the change takes effect.
15.2 Notices
We may give you notices in-app, by SMS, or through another contact method linked to your account. You agree that notices delivered in this way satisfy any legal requirement that a notice be in writing.
15.3 Entire agreement
These Terms and the Privacy Policy are the entire agreement between you and Haya about the Service, and supersede any prior agreements.
15.4 No waiver and severability
If we do not enforce a right under these Terms, that is not a waiver of that right. If any part of these Terms is held to be unenforceable, the rest will continue to apply.
15.5 Assignment
You may not assign or transfer your rights under these Terms. We may assign our rights and obligations under these Terms to an affiliate or in connection with a merger, acquisition, or sale of assets, on notice to you.
15.6 No employment, partnership, or agency
Nothing in these Terms creates an employment, partnership, joint venture, or agency relationship between you and Haya.
